Terms of Service — Mohspro Technician

These Terms of Service ("Terms") govern your access to and use of Mohspro Technician (the "App"), provided by MOHSPRO TECHNICAL SERVICES INC, 1501 NW 81 AVENUE, PEMBROKE PINES, FL 33024 ("we", "us", "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

This App is a business tool intended for use by Mohspro technicians to view scheduled appointments, appointment details (time, company, site location, doctors, managers), track appointment time (check‑in/check‑out), and record the number of cases performed (histopathology).

1) Eligibility

The App is intended for professional use only. You must be at least 18 years old and authorized by MOHSPRO TECHNICAL SERVICES INC (or its authorized client) to use the App. If you access the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2) Accounts, Authentication & Security

You may need an account to use the App. Authentication is performed via phone number and one‑time verification codes sent by SMS that expire within approximately two minutes. Keep your device secure, do not share verification codes, and notify us promptly at mohsproteam@gmail.com of any suspected unauthorized access. You are responsible for activity that occurs under your account.

3) Fees

We do not currently offer in‑app purchases or subscriptions. Access to the App is provided under our agreements with your employer or with our clients.

4) License & Intellectual Property

We grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to use the App in accordance with these Terms and any policies we provide. We (and our licensors) own all rights in the App and its content. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the App except as permitted by law.

5) Your Responsibilities & Acceptable Use

You agree not to:

• Use the App in any unlawful, fraudulent, or harmful manner.
• Interfere with or disrupt the App or its security.
• Upload malicious code or attempt to access non‑public features.
• Misuse the App to extract data in bulk or build a competing service.
• Enter patient medical records or protected health information (PHI) into fields not intended for such data. The App is designed for workforce scheduling and operational tracking and is not intended to store patient medical records.

6) User Content

If the App allows you to submit data (e.g., appointment notes, case counts), you grant us a worldwide, non‑exclusive, royalty‑free license to host, store, process, and display such content solely to operate, maintain, and improve the App and our services. You represent that you have all rights necessary to submit such content and that it does not violate law or third‑party rights.

7) Third‑Party Services & Integrations

The App may interact with third‑party services (e.g., SMS gateway for authentication, Apple/Google push notification services). Your use of third‑party services may be subject to their own terms and privacy policies. We are not responsible for third‑party services.

8) Device Permissions & Push Notifications

The App may request permission to send push notifications to remind you of appointments or to check in/check out. You can disable notifications in your device settings, but core functionality (e.g., timely reminders) may be affected. The App does not request access to location, contacts, photos/media, microphone, or camera.

9) Service Availability & Changes

We may modify, suspend, or discontinue the App (in whole or in part) at any time with or without notice. We may also introduce new features or impose limits on certain features.

10) Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOHSPRO TECHNICAL SERVICES INC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED USD 50 OR THE AMOUNTS PAID BY YOUR ORGANIZATION FOR ACCESS TO THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.‍

12) Indemnification

You agree to indemnify and hold harmless MOHSPRO TECHNICAL SERVICES INC and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or violation of these Terms.

13) Termination

We may suspend or terminate your access to the App at any time, with or without notice, including where required by our client relationships or if you violate these Terms. Upon termination, your right to use the App will cease immediately.

14) Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida for any dispute arising out of or relating to these Terms or the App.

15) Apple App Store & Google Play

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and MOHSPRO TECHNICAL SERVICES INC, not Apple; and Apple is a third‑party beneficiary that may enforce these Terms. If you downloaded the App from Google Play, your use is also subject to Google Play's terms and policies.

16) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice within the App or by other reasonable means. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
